1. Approved position, area and range:
Areas forming a circle extending 3 nautical miles seaward from the four base points setting at the most outstretched part of Liuqiu Township, Pingtung County, and using the most outer rim as its boundary (Base Point O25: 22o20.82’N, 120o23.40’E; Base Point O26: 22o21.35’N, 120o22.78’E; Base Point O27: 22o20.79’N, 120o21.32’E; Base Point O28: 22o19.38’N, 120o20.50’E), but not including Liuqiu fisheries resources conservation areas, intertidal terrains, and port areas and their navigational passages. (Attachment 1 chart of fishing ground, Attachment 2 Coordinates in Longitudes and Latitudes of range of areas not included.)2. Approved area: 150.4 square kilometers
3. Approved Duration: 1 June 2000 to 31 May 2020
4. Approved types of fisheries: longline fishery, hook and line fishery, shellfish harvesting, and cage farming
5. Restrictions or affiliated conditions:
(1) Under the principle of taken from the public and used by the public, holder of the fishing right shall allocate 100% access fee, for full input to the management and building of fishing ground, and implemented in accordance with the conditions set forth in Attachment 3.
(2) Holder of fishing right shall carry out conservation of resources and preservation of the marine environment in accordance with the rules prescribed in the business plan, and provide annual report in writing on every 31 January. Upon review of the Council of Agriculture (in principle, performed bi-annually), in case the approved conditions prescribed in the Attachment have not been performed, the exclusive fishing right license shall be subject to revocation in whole or in part in accordance with the Administrative Procedure Act, article 123, and the holder shall have no right to request for recourse.
(3) Approved scope of exclusive fishing right fishery, precluding the use of the following sea areas which have been duly publicized:
i. Port areas and their navigational passage of naval ports, commercial ports, ports for exclusive use, fishing ports, and marinas.
ii. Areas of national parks.
iii. Areas which have completed compensation of exclusive fishing right and other losses.
iv. Mining rights approved in accordance with the Mining Act, and are still effective.
v. Any areas for exclusive use which have been publicized by the central or local government in accordance with the applicable law.
(4) In areas prescribed as follows, for joint use, the operations of exclusive fishing right are to be conducted under restrictions or the conditions as set forth in the Attachment, and the holder of the exclusive fishing right shall have no right of recourse:
i. All kinds of protected areas (such as marine protected areas, coral reef protected areas), natural reserves, fisheries resources areas and wetlands, which have been publicized by the government according to law.
ii. Areas where facilities are already in existence: such as fuel oil offloading buoys at sea, water inlet and outlet vents of power plants, etc.
iii. Areas publicized by the government according to law, for specific uses, while not prohibiting fishing activities.
iv. Overlap areas of Dapeng Bay Scenic Areas (area extending 600 kilometers seaward from high tide line of the coast), and area of this fishing right.
(5) The extent of fishing access to the exclusive fishing right shall be subject to the restrictions of fisheries conservation measures on fishing gears, fishing methods, fishing season as publicized by the government according to law.
(6) The area for cage farming is 1.09 square kilometers. The fishing right holder shall reserve an area of 0.03 square kilometers, for cooperation with government agency in aquaculture research. Notwithstanding, the details prescribed in the business plan and the actual extent of area used has to be agreed with the fishing right holder, for approval of this Council.

1. Approved position, area and range:
Areas surrounded by a line extending from Base Points between Dazhuang Village, Fangliao Township and Zhukeng Village, Shizi Township, 3 nautical miles seaward from the mean low tide line of the coast (Base Point A48: 22o9.78’N, 120o38.40’E; Based Point A49: 22o10.68’N, 120o41.58’E; Base Point A50: 22o13.80’N, 120o36.12’E; Base Point A51: 22o17.16’N, 120o35.40’E; Base Point A52: 22o20.94’N, 120o31.56’E; Base Point A53: 22o23.58’N, 120o33.18’E), but not including fisheries resources conservation areas, intertidal terrains, areas of fishing right demarcated, areas of set-net fishing right, and port areas and their navigational passages (width of navigational passages of ports already prescribed by the port authorities, and same will apply; for those not prescribed, the width will be 300 meters for out-bounding passage from ports, 100 meters for out-bounding passage in docks). (5) The extent of fishing access to the exclusive fishing right shall be subject to restrictions of fisheries conservation measures on fishing gears, fishing methods, fishing seasons as publicized by the government according to law.
(6) Principles on dealing with matters involving Taiwan Strait Mine Areas 1 and 2 of China Petroleum Corporation of Taiwan by the exclusive fishing right: Co-existence of exclusive fishing right and mining right. In case of authorizing exclusive mining right within areas of exclusive fishing right, article 29 of the Fisheries Act shall apply.
(7) In areas where the exclusive fishing right and the Fangshan of Air and Sea Shooting Exercise Control Area enjoy common usage, the holder of the fishing right shall prohibit those with access fishing right entering into and exiting from the areas, in accordance with the time of exercise so announced, and during the time announced there shall be no right of recourse.
(8) In areas where the area of the exclusive fishing right covers the waters of the Chunghwa Telecommunication Company’s Anchoring Prohibited Area, the operators of the access fishing right are prohibited from anchoring to avoid damaging the submarine cable laid.

Areas extending 3 nautical miles seaward from the mean low tide line of Donggang Township and Xinyuan Village (Base point A54: 22o23.13’N, 120o27.30’E; Base point A55: 22o25.84’N, 120o28.86’E; Base point A56: 22o25.93’N, 120o23.36’E; Base point A57: 22o28.68’N, 120o25.45’E), but not including of Dapeng Bay National Scenic Area, port areas and their navigational passages, and other exclusive waters as publicized by the government in accordance with the relevant laws and regulations. 3. Approved Duration: 15 July 2014 to 14 July 2024
